Booking Details

Please complete the Annual Rental Agreement once per year (renewing each August) to gain access to our online booking software.
Please expect a 72 hour response + activation window for new clients.

Restrictions

TRAC is an inherently loud place and we do NOT suggest people rent the space for Yoga or Meditation.
We do not host Birthday parties, bridal showers or bachelorettes.
The use of drugs or alcohol is strictly prohibited.
NO outdoor shoes are to be worn within any of the studios.

Rental Agreement for Licensees of The Railpath Arts Centre Inc.

This online form is valid upon submission until August 31, 2024 and does not need to be resigned or resubmitted prior to the date of expiry. Use of The Railpath Arts Centre Inc., also referred to as "The Railpath Arts Centre", is contingent upon the Licensee's, also referred to as the "Renter's", understanding, acceptance and adherence to the following policies and schedules. Noting the "Premises" refers to The Railpath Arts Centre Inc's fixed address of 35 Golden Ave, Suite 107, 108, 109 and its shared public spaces at 35 Golden Ave such as the Public Washrooms, Hallways, Parking Lots, and Courtyards.

Shared Space Agreement

The Railpath Arts Centre is a shared space with people from all walks of life, across multiple demographics. We ask you keep use of explicit music to a minimum and please play all music at a volume that will not transfer through the walls to adjacent studios / lobby areas.

Policies:

1. Payment must be complete in advance - upon booking or, for long term Renters, once invoiced. 2. In order to obtain studio access and invoices, it is the Renter's responsibility to maintain an up to date online account and to ensure email preferences are selected for account management + schedule reminders and changes. 3. It is the Renter's responsibility to read, understand and follow appointment reminders and rental information sent via email as well as contact The Railpath Arts Centre via email or text if rental information has not been received 1 day prior to a booking. 4. It is the Renter's responsibility to obtain the appropriate or applicable insurance required to run classes/rehearsals as well as create contracts for their clients, guests or rehearsal partners. 5. It is the Renter's responsibility to monitor those that join them. Thus, Renters must remain on the Premises at all times when their clients, guests or rehearsal partners are. 6. Rentals including Minors (people under the age of 18) must remain under proper adult supervision at all times, within all areas of the Premises. 7. It is the Renter's responsibility to inform all those that join them to take safety precautions within the Premises as The Railpath Arts Centre is not responsible for accidents, injury, illness or individual property. If there is an critical accident, injury, illness, theft or other incident, immediately notify The Railpath Arts Centre via TEXT at 647-409-3115 and call 911 when applicable. 8. It is the Renter's responsibility to apply or communicate the correct rental rates per booking. All classes, workshops, private lessons, studio showings, etc. where patrons, collaborators or clients pay to attend should be booked at standard studio rates. Should a Renter, or anyone who joins them, violate any items of this Agreement or its adjoining Schedules, The Railpath Arts Centre will have the right to terminate this Agreement and all future bookings without refund.

Liability and Indemnification

August 26, 2023 - August 31, 2024 In submitting this Agreement, I, the undersigned and, if applicable, the company I represent, certify that I have read, that I understand and that I will abide by the facility rules, regulations, policies and procedures set forth for the entirety of this agreement with The Railpath Arts Centre Inc. I certify that my intended use is in compliance with The Railpath Arts Centre Inc.’s rules, regulations, policies, procedures and agreements and that I am responsible to show care and respect for the health and safety of all the persons I bring to 35 Golden Ave, Suite 107, 108, 109 and shared public spaces at 35 Golden Ave known as the “Premises”, including but not limited to the staff and participants who attend my events and the Premises themselves. I hereby agree to indemnify, free and hold harmless The Railpath Arts Centre Inc. and its individual members thereof, all officers, agents, students, clients, members and staff from any claim of loss, damage, liability, cost, accident, injury, illness or disease known or unknown including economic, environmental or emotional damage or expense that may arise during or be related to the use or occupancy of The Railpath Arts Centre Inc. and the Premises. I, the undersigned, and, if applicable, the company I represent, will be responsible for any damages sustained to the The Railpath Arts Centre Inc. and the Premises and I, or the company I represent, am responsible for maintaining any and all appropriate insurance necessary to carry out practices or events within the Premises. Any lost equipment or damages sustained as a result of this Rental Agreement to The Railpath Arts Centre Inc. property or the Premises shall be compensated within three days. I agree that this reservation is granted with understanding The Railpath Arts Centre Inc. may cancel if needed for The Railpath Arts Centre programs. I have read, I understand and I agree to abide by the rules, regulations, policies and procedures listed in The Railpath Arts Centre Inc. Rental Agreement for Licensees of The Railpath Arts Centre Inc. and its attached Schedules.

Cancellation Policy and Surcharges

Cancellation Policy: A rental can be modified online, in person, via email or phone call up to 48 hours before the scheduled arrival time. Full cancellations, with refund, can be made with 72 hours notice prior to the scheduled arrival time. Full cancellations, with refund, or modifications greater than 10 hours are subject to a $90 administrative fee. In the highly unlikely scenario that The Railpath Arts Centre is forced to cancel this Agreement or a specific rental, a full refund or credit for the paid time will be issued by The Railpath Arts Centre within 7 days, so long as the the Renter has upheld the Agreement in full. Surcharges: Any outstanding balances more than 14 days past due will be subject to a 15% per annum late fee compounded daily. Anyone seen to be entering the space without notice or using the space outside of their scheduled time frame will be invoiced and charged for the extra time. To avoid these charges, please notify The Railpath Arts Centre if you need to access the space for any reason outside of the scheduled time or to confirm an extension to a Rental is indeed possible based on the room schedule. Our security camera footage is monitored intermittently to ensure upkeep of the Premises and the appropriate charge will be processed to the Credit Card on file or invoiced if The Railpath Arts Centre has determined it is needed to cover the cost of cleaning or repairing any damage that occurred as a result of the Renter's actions. HVAC adjustments that are fully not communicated and restored will be monitored via security cameras and subject to a minimum $25 fee per occurrence. Storage is limited to Renters using the space on 5+ consecutive days. Storage fees will start a $10 / day plus hst and increase based on space required.

The Premises are Licensed in “As Is” Condition.

By placing my name below I herby sign this Agreement, which includes the Liability and Indemnification section and adjoining Schedules. This Agreement shall come into effect on the above start date and shall terminate on 31st day of August 2024.
